Article 2 : App description The Serenity Alcotrack Premium application is a mobile application that allows you to test the blood alcohol level of a person in a scheduled or on-demand manner. The application is coupled with a breathalyzer approved by the Manoova company. The results are then sent to the customer\'s administrator via a back office interface. The main mission of the Serenity Alcotrack service is to help organizations prevent the risks of accidents related to alcohol consumption in the professional context. Article 3 : Contact For any questions or requests for information concerning the application, or any report of illegal content or activities, the user can contact the publisher at the e-mail address [email protected] Article 4 : Acceptance of the terms of use The access and use of the application are subject to the acceptance and compliance with these General Terms and Conditions of Use. The publisher reserves the right to modify, at any time and without notice, the application and the services as well as these General Terms and Conditions of Use, in particular to adapt to the evolutions of the application by making available new functionalities or deleting or modifying existing functionalities. It is therefore advisable for the user to refer to the latest version of the General Terms and Conditions of Use, accessible at any time in the application, before any use. In case of disagreement with the General Terms and Conditions of Use, no use of the application can be made by the user. Article 5 : Access and navigation The publisher implements the technical solutions at its disposal to allow the use of the application 24 hours a day, 7 days a week. However, they may at any time suspend, limit or interrupt access to the application or to certain screens of the application in order to update, modify its content or take any other action deemed necessary for the proper functioning of the application. The present General Terms and Conditions of Use apply, as necessary, to any variation or extension of the application on existing or future social and/or community networks. Access to the Serenity Alcotrack Premium application is conditioned by a connection requiring a registration number, a login and a password. The registration of each user is done by the client\'s administrator from the Serenity Alcotrack back office interface. Then, the administrator communicates the registration number, the login and the password to each user who has the possibility to modify it. The very first connection requires an internet connection. The same applies to the password change. Once connected, the user can perform tests in offline or online mode. The test results will be sent to the administrator as soon as the application is connected to the internet. He can consult the test schedule that has been assigned to him or do an offline test according to the instructions of his administrator or his supervisor. The user can also consult his own results directly in the application. He can also modify some configurations of the application such as the language, the unit of measurement and activate the sound signals. Article 6 : Responsibilities The Serenity Alcotrack Premium application and the entire solution offered by the Serenity Alcotrack platform provide indicative results and cannot in any case replace the measuring instruments used in the context of forensic medicine or road safety. MANOOVA clearly states that under no circumstances, the indications provided on the application, can constitute a medical, driving or other authorization. Therefore, MANOOVA is not responsible for any direct or indirect, material or immaterial, foreseeable or unforeseeable damages resulting from the use or difficulties of use of the application or its services. Article 7 : Confidentiality In addition to these General Terms and Conditions of use, the application has a privacy policy that describes how personal data are processed when the user uses the application, as well as how cookies are used. By using the application, the user declares that he/she has also read the aforementioned privacy policy. Article 8 : Intellectual property The structure of the application as well as the texts, graphics, images, photographs, sounds, videos and all elements that compose it are the property of the publisher and are protected as such by the laws in force under intellectual property. Any representation, reproduction, adaptation or partial or total exploitation of the contents, trademarks and services offered by the application, by any means whatsoever, without the prior, express and written authorization of the publisher, is strictly prohibited and would be likely to constitute an infringement. The use of the application does not imply the recognition of a right and, in general, does not confer any intellectual property right relating to an element of the application, which remain the exclusive property of the publisher. Article 9 : Applicable law and competent jurisdiction These General Terms and Conditions of Use are governed by Malagasy law. In case of dispute and in the absence of an amicable agreement, the dispute will be brought before the Malagasy courts in accordance with the rules of jurisdiction in force.
